Terms & Conditions (AGB)

These Terms & Conditions govern all purchases made through the online store www.incentive-cashmere.com, operated by:

1. Scope

These Terms & Conditions apply to all orders placed through our online store by consumers and business customers. Consumers are any natural persons who make a purchase for purposes not primarily related to their trade, business, or profession.

2. Contract Formation

  • The product presentations in our online store are non-binding and serve as an invitation to place an order.

  • By placing an order via our website, you submit a binding offer to purchase.

  • A contract is concluded once we confirm your order by email.

3. Prices & Payment

  • All prices are stated in EUR and include statutory VAT, unless otherwise indicated.

  • Shipping costs are calculated separately and shown during checkout.

  • Payment methods are displayed at checkout (e.g. Shopify Payments, PayPal, Klarna, credit card, etc.).

  • Payment is due immediately upon order confirmation.

4. Delivery & Shipping

  • Goods are shipped from Italy and Germany via trusted carriers.

  • Delivery times: 3–7 business days within the EU, 7–14 business days internationally (depending on customs).

  • Customers outside the EU are responsible for any customs duties or import taxes.

5. Right of Withdrawal (EU Customers)

Consumers in the EU have a legal right to withdraw from this contract within 14 days without giving any reason.

Withdrawal period:

  • The period is 14 days from the day you (or a third party named by you, who is not the carrier) receive the goods.

How to withdraw:

  • To exercise your right, you must inform us in writing (by email or letter) of your decision to withdraw.

  • You may use our Standard Withdrawal Form, but it is not mandatory.

Refunds:

  • If you withdraw, we will refund all payments received (excluding shipping costs) within 14 days from the day we receive the goods.

  • Refunds are issued using the same payment method used for the original order.

Return shipping costs:

  • Customers are responsible for the cost of return shipping.

6. Return & Exchange Policy

In addition to your legal withdrawal right:

  • We are happy to arrange an exchange if the requested size is available.

  • Return shipping costs are borne by the customer.

  • We cover the cost of shipping the replacement item back to you.

  • Returned goods must be unworn, undamaged, unwashed, and with original tags attached.

  • Items that do not meet these conditions will not be refunded. They will remain with us unless the customer requests return at their own cost.

7. Warranty & Liability

  • Legal warranty rights apply.

  • Our liability is limited to intent, gross negligence, and essential contractual obligations.

  • We are not liable for indirect damages unless caused intentionally or by gross negligence.

  • These limitations do not apply in cases of injury to life, body, or health.

8. Privacy & Data Protection

We handle personal data in accordance with GDPR. Details can be found in our Privacy Policy.

9. Governing Law & Jurisdiction

  • German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

  • For consumers in the EU, mandatory consumer protection rights of your country remain unaffected.

  • Jurisdiction for business customers is Hanau, Germany.

10. Online Dispute Resolution

The European Commission provides a platform for Online Dispute Resolution (ODR):

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Taxes & Duties

All prices on Incentive Cashmere are shown in euros (€) and include German VAT (19%), where applicable.
Orders shipped within the European Union include VAT in the displayed price.

For orders delivered outside the European Union — including the United Kingdom, Switzerland, Norway, the United States, and Canada — VAT is not charged at checkout. These orders may be subject to import duties, customs fees, or local taxes upon arrival in the destination country. Such charges are determined by local authorities and are the responsibility of the recipient.

We do not collect or control these costs and cannot predict their amount, as they vary by country and order value.

All international shipments are sent from Germany.
Customers are advised to check with their local customs office for more information regarding import duties and taxes.

12. Order Quantity Limitation

To maintain the exclusivity and artisanal quality of our limited-production collections, we kindly enforce a maximum purchase limit of three (3) items per customer per order. Orders exceeding this limit may be adjusted or cancelled at our discretion. Thank you for understanding and supporting responsible, boutique-level craftsmanship.
